Below is our acceptable use policy (hereafter referred to as AUP). While we don't plan any major changes to this in the near future we do reserve the right to change it without notice but in most cases we will endeavour to give 30 days notice of any changes. It outlines what we consider to be acceptable and unacceptable uses of our web hosting service. Breaching this AUP can and may result in the suspension or termination of your the account and all other accounts that you may hold with us regardless of any status you may have. Before we begin, we would remind you that Assembly Web Services is part of the VerseADay partnership and therefore your agreement is with the VerseADay partnership, therefore we will refer to ourselves throughout this document as VerseADay.
If you are registering a domain with us (VerseADay) then the policies found here also apply and are thereby included within this agreement (the AUP).
General.
We expect all of our customers to behave in a polite and courteous manner towards fellow users of the Internet and our services. In order to open an account with VerseADay you must be 16 years of age or older.
Email / Spam.
We take spam mail very seriously, we will instantly suspend an account if we are led to believe the owner is involved in unsolicited bulk mailing regardless of whether they are using our system to carry out their activities or not.
Mailing Lists.
We also take very seriously the act of subscribing someone to an electronic mailing list without their prior consent. If you are running a mailing list it is your responsibility to make sure that users whose email addresses are entered actually want to be subscribed to your mailing list, if we receive complaints that you are not doing this we may at our discretion and without warning terminate your account.
Mail-bombing.
Any user that is found to be participating in the act of mail-bombing (inundating a user with email without a serious intent to correspond with them) shall have their account terminated. Any user who is repeatedly the subject of such attacks (or attracts such attention) will be asked to leave our system.
Unlawful Use.
General. Unlawful uses of our services includes (but is not limited to): drug dealing; pirating; hacking; cracking; copyright infringement; gambling; distribution of obscene materials; fraudulent activity; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; VerseADay reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.
MP3s.
MP3s are acceptable on our servers as long as you personally own the copyright to the material stored therein e.g. You have recorded your band playing your latest track, or have recorded a Bible teaching meeting and have the speakers permission to upload the message, (of course without any copyrighted songs). We will not tolerate the storage, distribution, promotion or linking to of illegal MP3s as these MP3 files constitute a breach of international copyright agreements, such violations shall be taken very seriously and reported to the appropriate authorities. We reserve the right to inspect all MP3 files (or files suspected of being MP3s e.g. Zip files containing them, files with altered extensions).
Pornography.
Pornography and sex-related merchandising, or links to such material, even if legal, is not an acceptable use of VerseADay services and we will immediately, without warning, terminate your account.
Anti-Christianity.
We are a partnership of 3 Christians and will therefore not tolerate anything that is anti-Christian or anti-Biblical being published on or linked to from our services. We reserve the right to terminate any account that fails to respect this.
Abuse of Server Resources.
Abuses of our server resources includes (but are not limited to): Running background tasks without prior written permission; running chat rooms; Internet Relay Chat; IRC Bots; daemons and other executable files; receiving more than 1000 emails a day. Further more any usage of 10% or greater resource usage (CPU, Memory etc.) is an undue burden to our system and is not acceptable - If you do not comply with this ruling then your account may be terminated immediately without notification (You will have the right to appeal to us and no other body). Domains that use more than 5 Gigabytes of transfer bandwidth may be suspended or terminated immediately (If you need more than 5 Gigabytes per month of transfer bandwidth we can arrange this with you). Also unacceptable is the use of scripts to run two websites from the same account e.g. Pointing two domain names at your space and using a script to point them to different directories, if you would like to use multiple domains for your site, all of our accounts offer you the opportunity to host more than one domain in that account for a small monthly fee (at the time of writing this document it is 50p per domain per month, but this may change in the future) and some of the accounts already include this for free for a small number of domains.
Hacking/Cracking.
VerseADay reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution.
The following examples of unacceptable behaviour are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please ask abuse@assemblywebservices.co.uk
Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network. Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX. Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken. The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination of accounts held by the user.
Client Responsibility.
The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site, and material that may be put on by a third party (such as the usage of Free For All links pages). Use of VerseADay services requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of VerseADay to provide this knowledge or support outside matters specific to our services.
Backups.
Incremental backups (backups of new/changed data) of data are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and any information. If loss of data occurs due to an error of VerseADay, we will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of the client in securing their account or by an action of the client, then VerseADay will attempt to recover the data at the clients expense, the fee will depend on how much time is required to do this.
IP Numbers/Addresses.
VerseADay maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.
Limitation of Liability.
VerseADay shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from VerseADay servers going off-line or being unavailable for any reason whatsoever. Further, VerseADay shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of VerseADay servers. All damages shall be limited to the immediate termination of service.
In the event of financial difficulties VerseADay reserves the right to close down AssemblyWebServices.co.uk. All accounts will be terminated at the end of their current billing month and applicable monies will be returned for any pre-paid months at a pro-rata rate where possible. We will look into whether we are able to provide for you any alternative hosting services. In the event of closure due to financial difficulties we will transfer your domains without charge to any other provider you are able to find (obviously any fee that the other provider charges will have to be met by you).
VerseADay shall be the sole arbiter of what is and is not a violation of these acceptable use policies. VerseADay reserves the right to terminate an account at any time and for any reason that causes harm to any of VerseADay customer web sites. VerseADay reserves the right to delete all content and files upon termination. VerseADay reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. VerseADay reserves the right to refuse, cancel, or suspend service at our sole discretion.
VerseADay reserves the right to change the Acceptable Use Policy without prior notice or warning. Non-enforcement of any part of the Acceptable Use Policy does not constitute consent.
Violations of these Acceptable Uses Policies should be referred to abuse@assemblywebservies.co.uk, all complaints will be investigated promptly.
